WASHINGTON, D.C. – Max Miller's lawyer has confirmed that his client provided inaccurate information regarding a witness in court filings and during a hearing while seeking a protection order against his ex-wife.
According to documents, in February, Mr. Miller claimed that his girlfriend was present at the house during a custody exchange on February 1—the time the dispute occurred with his ex-wife, Emily Moreno.
During this event, Ms. Moreno accused Mr. Miller of violent behavior, while Mr. Miller denied the allegations, asserting that a witness could confirm there was no physical altercation.
However, nearly two weeks later, Mr. Miller's legal team sent an email to the opposing side, admitting that the individual named as a witness “could not have been present at that time.”
Despite this, Mr. Miller's side still maintains that surveillance video footage shows no signs of conflict.
Ms. Moreno's lawyers requested that Mr. Miller withdraw or amend the request for the protection order. After being refused, they asked the court to apply sanctions against Mr. Miller's legal team.
The incident takes place amidst a continuing, tense custody dispute between the two parties following their divorce.
A judge granted the protection order for Mr. Miller but found no grounds to apply a similar measure for the child.
The case continues to be processed in court, with numerous allegations and counter-allegations from both sides.
